General Terms and Conditions (GTC) for Artworks and Commissioned Works
1. Scope
These General Terms and Conditions apply to all contracts concerning the sale of artworks and the creation of individually commissioned works between Anna Alexandra Wati (hereinafter referred to as the “Artist”) and her customers.
2. Inquiries and Conclusion of Contract
Inquiries regarding artworks and commissioned works may be made by email. A contract is concluded once the Artist confirms the customer’s offer in writing or begins creating the commissioned artwork. Individual arrangements, particularly regarding the subject, size, materials, price and estimated completion time, will be agreed upon in writing before work begins.
3. Commissioned Works
Individually commissioned artworks are unique, custom-made works. The customer acknowledges that handmade artworks may have individual characteristics. Variations in colour, texture or execution do not constitute defects but are an expression of the artistic process and design.
4. Changes and Consultations
Requests for changes after the artistic work has begun can only be accommodated if technically feasible and possible within the available timeframe. Any additional costs resulting from such changes may be charged separately. Drafts, sketches and conceptual work remain the property of the Artist unless expressly agreed otherwise.
5. Prices and Payment
The agreed remuneration is determined by the individual agreement between the Artist and the customer. For commissioned works, a deposit of 50% of the agreed price is due before work begins. Completion and/or handover of the artwork will take place after full payment has been received.
6. Delivery and Handover
Handover will take place as individually agreed, either by collection, personal delivery or shipping. Where an artwork is shipped, packaging and shipping costs will be charged in addition to the purchase price of the original artwork in accordance with the individual agreement.
7. Ownership and Copyright
Upon full payment, ownership of the physical artwork passes to the customer. Copyright in the artwork remains with the Artist.
The purchase of an artwork does not grant the customer any right to reproduce, commercially exploit, modify or otherwise adapt the artwork.
8. Publication and Presentation
The Artist is entitled to use images of completed artworks, including after their sale, for her own purposes, such as on her website, in her portfolio, on social media or in exhibitions, unless otherwise agreed.
9. Warranty
Statutory warranty rights apply. Handmade artworks may exhibit minor variations in colour, application of paint, surface texture and material characteristics, as well as small irregularities. These are characteristic features of an individually handmade original and do not constitute defects, provided that they do not adversely affect the agreed characteristics of the artwork.
10. Cancellation of Commissioned Works
As commissioned works are created individually according to the customer’s specifications, cancellation after work has begun is only possible by individual agreement with the Artist. Any costs already incurred and work already performed will be charged to the customer.
11. Final Provisions
Should any individual provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
The laws of the Federal Republic of Germany shall apply.
